TERMS AND CONDITIONS
Enrollment, Membership and all related benefits of the VIPpro Program Mobile Membership are offered at Lowe's, Réno-Dépôt & Rona discretion. Use of the VIPpro Mobile Membership ID and Barcode constitutes acceptance of, and is subject to, the terms and conditions of The VIPpro Program, which Lowe’s Canada may change without notice at any time.
1. PRESENTATION OF THE VIPPRO PROGRAM
The VIPpro Program (hereinafter called the "Program") is a program provided by RONA inc. & Lowe’s Companies Canada ULC (hereinafter called "Lowe’s Canada") for Lowe’s, Réno-Dépôt and Rona banners for their clients of the following classifications: companies involved in building construction, renovation, repair and maintenance. This includes self-employed trades people, contractors, property management companies, commercial, industrial & government organizations or associations, churches and agricultural operations. To take advantage of the Program, the client must be a Canadian resident, have a company client number in one of the three banners of Lowe’s Canada computer store systems and/or in the mobile application, have registered to the Program and obtained its PRO Member Identification number (ID), or any other device or technology that may be approved by Lowe’s Canada from time to time (hereinafter collectively called the "PRO Member ID"). The client must have a valid email address with which we can provide regular Program administration communications.
By using his PRO Member ID, the client confirms his approval of the Program Terms and Conditions, including any modification that may be applied by Lowe’s Canada at an ulterior date, if needed and at Lowe’s Canada sole discretion. Please read all Program Terms & Conditions carefully and visit the Program's website regularly, at https://www.vip-pro.ca, also available in the Program application, to review any new modifications implemented to these Terms & Conditions. The online version of these Terms & Conditions shall prevail on any other document that could be on the market.
2. ELIGIBILITY, REGISTRATION AND MEMBERSHIP
The Program is open to Canadian residents who are contractor clients at Lowe’s Canada, who have a company client number in one of Lowe’s Canada banners computer systems and/or in the mobile application. The PRO Member ID allows the client to participate to the Program and the client holding a validly issued PRO Member ID is a PRO Member (hereinafter called the "PRO Member"). No membership fees are required to join the Program. The PRO Member must register to the Program by visiting the contractor desk at his/her participating Lowe’s, RÉNO-DÉPÔT or RONA store or by the mobile application. Lowe’s Canada reserve the right to remove any client from the Program whose representatives do not act in an ethical manner or for reasons unspecified. Duplication of fraudulent accounts will forfeit a client’s eligibility to this Program.
To receive Program information and/or updates, the PRO Member must do one of the following actions:
In store – please visit any local Lowe’s, RÉNO-DÉPÔT or RONA participating store and the Contractor desk partners will be able to provide you with further information about the Program or visit vip-pro.ca.
The PRO Member hereby agrees to receive by email any further updates, newsletters, special offers and other information about the Program and Lowe’s Canada promotion. A PRO Member can unsubscribe at any time to such promotional emails.
3. THE PRO MEMBER ID
Registration to the Program is automatic upon the validation by Lowe’s Canada of the PRO Member information. The PRO Member ID is valid immediately upon reception. All PRO Member ID application requests are subject to approval from the Pro Desk in participating Lowe’s Canada stores. The PRO Member ID is accepted at all participating Lowe’s Canada stores. The PRO Member ID is the property of Lowe’s Canada and identifies its holder as a member of the Program. The PRO Member ID is not transferable.
4. DESCRIPTION OF THE VIPPRO PROGRAM FEATURES AND BENEFITS:
4.1. Business opportunities -
A PRO Member may become a certified Lowe’s Canada Installer. To become a certified Lowe’s Canada Installer, the PRO Member must complete the application form and information sheet from Sales and installation services. According to this department's requirements, PRO Member applicants will be called in for an interview; in case of positive results, a business agreement and a Code of conduct will be signed between both parties.
4.2. Events Invitation -
PRO Member may be invited to various events and opportunities according to their profile and member status. Lowe’s Canada reserves the right to select and invite PRO Member at its sole discretion. A PRO Member who cannot attend an event to which he/she was invited may not necessarily receive an invitation to another event during the same year.
4.3. Exclusive offers and coupons -
Exclusive offers will be sent to PRO Member by email; those offers will be applicable upon presentation of the PRO Member ID only, during the promotion validity period.
4.4. Payment Options -
Various payments options may be provided to a PRO Member to pay for his/her purchases: The PRO Member may use another form of payment accepted at Lowe’s Canada if he chooses to do so, including cash or debit. At all times, to take advantage of one of the flexible payment options specified above, the PRO Member must specify the preferred payment method to the merchant upon each transaction.
4.5. Pro Special Pricing -
Preferred pricing: PRO Members benefit from a 10% off discount on the regular price of products in the paint category, as well as a 5% off discount on the regular price of products of all other categories, subject to the exceptions mentioned hereunder. Some product categories may be excluded from time to time at Lowe’s Canada sole discretion.
The PRO Member special preferred pricing apply before taxes, on the regular price of applicable products and does not apply to items on sale or non-discountable items including without limitation the following branded products : Sico Évolution, Sico Muse, Amazon, Canexel, Rockwool, Dyson, Google Home, Nest, Ecobee, Broil King, Kamado Joe, Napoléon, Traeger, Weber, Arlo, Samsung Smart Home, iRobot, Ring, Lutron Caseta, Ariens, Husqvarna, EGO. Lowe’s Canada reserve the right to change their non-discountable assortment at any time. We reserve the right to limit quantities. Cannot be combined with any other offer. Only purchases at regular price paid in cash, debit, credit card are eligible. More specifically, this offer does not apply on prices that indissociably covers not only the product, but also installation services (such as hard surface countertops prices). Cannot be used in conjunction with any other coupon, discount, instant savings or rebates on kitchen cabinets or promotional offers including: Lowe’s Canada employee discounts, Build up plan incentives, or any other special pricing programs and price match hassle free. Cannot be used in conjunction with the following products and/or services: extended protection plans, installation, shipping, assembly, rentals, cut-shop service, delivery charges, service purchases, labour, tool rentals etc. or previous sales. Gift card, special orders or purchases made with in-store accounts or purchases made by clients with a specific contractual agreement executed with Lowe’s Canada are not eligible for this offer. Doesn’t apply to previous purchases and layaways. Not convertible into cash.
Eligibility to a preferred pricing under the Program is conditional upon the PRO Member ID being active. If the PRO Member ID is related to a charge account, this account must not be overdue upon the attribution of Program benefits. The PRO Member understands that his purchases will be monitored periodically.
• Contract pricing (single or group commitment): upon request, a preferred pricing structure can be established by Lowe’s Canada for specific products, a given project or for a given period of time.
4.6. Other features of the Program:
Various advantages in store and during special events may be added throughout the year.
5.PROTECTION OF PERSONAL INFORMATION AND PROMOTIONAL EMAILS
Upon registration to the Program, Lowe’s Canada will collect personal information, including without limitation name, address, phone number and email address. Lowe’s Canada will use this information in collaboration with its authorized agents to manage customer participation to the Program. Lowe’s Canada also reserves the right to share some of this information about Program members periodically with its subsidiaries and its suppliers, primarily so that Lowe’s Canada, its merchants, its subsidiaries and its suppliers can offer their products and services to Program members.
6. PROGRAM MODIFICATIONS
Lowe’s Canada reserve the right to modify, suspend or cancel the Program, in whole or in part at any time, with or without prior notice. Such changes may modify the benefits related to the Commercial credit card, charge account, the Program, or other programs. Without limiting the foregoing, Lowe’s Canada reserve the right to cancel or to modify the preferred pricing structure or any discount levels granted under a preferred pricing at any time. Any such changes will be made in new Terms and Conditions posted on VIPpro website at https://www.vip-pro.ca and will be effective from the date of posting unless stated otherwise. The PRO Member is solely responsible for checking the VIPpro website to be aware of the current Terms and Conditions for the Program.
Despite the efforts made by Lowe’s Canada to ensure the accuracy of the information provided including the prices and offers, it is possible that errors appear from time to time. No guarantee, implied or explicit, is made with respect to said information. Consequently, Lowe’s Canada reserve the right to correct these errors at any time, even if the error has an impact on the current Program benefits. Lowe’s Canada decline any liability for any and all such errors, omissions, inaccuracies and reserves the right to cancel an order at any time without notice.
7.GOVERNING LAW AND DISPUTE RESOLUTION
These Terms and Conditions shall be governed by the laws of the Province of Quebec and the laws of Canada applicable therein. Each party irrevocably attorns and submits to the exclusive jurisdiction of the courts situated in Montréal and waives objection to the venue of any proceeding in such court or that such court provides an inconvenient forum. All decisions regarding the interpretation of these Terms and Conditions shall be at the sole discretion of Lowe’s Canada and shall be final and binding in all respects. To report an apparent discrepancy, or to request information about your membership status, please contact your participating Lowe’s Canada store. If you disagree with any modifications to the Program or to these Terms and Conditions, your sole recourse will be to terminate your membership in the Program – this termination shall not dispense the Member of paying any current transactions or outstanding account balances.
Lowe’s Canada reserves the right to cancel benefits without notice to the PRO Member, in the event that the PRO Member, with respect to the Program, fails to honor the Program's Terms and Conditions; commits fraud or makes false or misleading statements; or otherwise misuses the Program. Lowe’s Canada is solely responsible for administering the Program. By taking part in the Program, the PRO Member agrees to compensate, indemnify and hold harmless Lowe’s Canada, its subsidiaries and related entities and all merchants of Lowe’s Canada network with respect to any loss or damages that may be incurred by the PRO Member while taking part in the Program, including but not limited to any litigation respecting the value of the cash back in the form of Lowe’s Canada gift cards.
